The Online Shop at www.mussner-textile.com is for companies (hotels, residences, retailers, wholesalers etc.)

Applicability
The General Terms and Conditions of Sale exclusively are applicable to all business relations between Mussner and purchaser companies (hotels, residences, retailers, wholesalers etc.) making purchases at the online shop www.mussner-textile.com.

1. prices
All prices shown on the web site are in Euro and do not include VAT (value-added tax). By using the products and services on www.mussner-textile.com the purchaser agrees without limitation or qualification to this general terms and conditions of Mussner. Until they are modified, these Terms and Conditions of Purchase shall be applicable also to all further orders. By clicking on the “Send order” button, the customer submits a binding order for the goods included in the shopping basket. The purchaser has to insert during the order process his company vat (tax) number. Only for deliveries to companies in Italy Mussner will automatically apply in the invoice the legal VAT. For all deliveries to countries member of the European Union the invoice will be without VAT. For all deliveries outside of the European Union there will be an export invoice with no tax.

2. minimum order quantity
In the case of initial orders by a purchaser there a specific minimum order quantity. For subsequent orders there will be no minimum order quantity. 

3. payment
The purchase price becomes due immediately. Payment is always to be made in advance. Payment may be made either by bank transfer, Paypal or credit card (visa, master card, American express, ecc). First-time customers on a B2B basis shall pay in advance. For regular costumers it is possible to agree to personalized payment options. 

4. offer
Mussner reserves the right to change any of the content described in this website at any time without notice.. Any little divergence to the illustrations in the catalogue and on the internet are entirely possible and do not give to the purchaser the right to claim.

5. order
The minimum order amount is 250,00 Euro (without VAT.). Mussner will confirm receipt of the customer’s order immediately and automatically. The confirmation of receipt still does not constitute binding acceptance of the order. The contract of purchase does not come about simply upon confirmation of the order but only upon sending of confirmation of delivery or delivery of the goods.

6. delivery
Goods that are in stock will be dispatched within 3 working days. Any reasonable part shipments and partial services are permitted. The average delivery time is approx. between 7 – 10 days. Due to unpredictable circumstances or for personalized items it is possible to have longer delivery times. The purchaser will be immediately informed about the delivery time. The delivery will be executed to the delivery address given by the customer. In the event that the customer refuses to accept the goods or in the event that the delivery of the shipment is delayed for any other reasons for which the customer is responsible, the risk shall be transferred not later than the beginning of the delay in acceptance by the customer. Shipment costs are charged for separately and are indicated at the end of the order.

7. shipment cost
In addition to the quoted prices we charge 3 % shipment cost calculated at the good amount for orders up to 4.000 Euro. If the value of the purchase order exceeds 4.000 Euro the shipment cost will be 3 % of the purchase amount. The shipment costs are set out in the shopping cart system and on the ordering page. For delivery out of the European Union the shipping costs will be confirmed or recalculated in a separate email after the automatic email confirmation,

8. delivery delay and renouncement
Delivery and service delays due to force major and due to events, which prove very difficult or impossible for delivery, such as strikes, lockouts, orders of authorities, in particular, also if these occur to Mussner’s suppliers or their sub suppliers, and even if deadlines and dates are fixed and binding, require no justification by Mussner. These circumstances entitle Mussner to postpone the
delivery or the service by the duration of the difficulties, including appropriate preparation time, or even to renounce the contract partially or completely.

9. liability of defects
The customer must check the goods delivered immediately for quality and quantity discrepancies, and must notify the seller in writing of recognisable defects within a period of 5 days following receipt of the goods; otherwise, the assertion of warranty claims shall be excluded. If the customer fails to examine or notify defects on time, the goods delivered shall apply as approved. 

10. Retention of title
The seller reserves title to the goods up until full payment of all claims from the current business relation.

11. Place of fulfillment and jurisdiction
The place of fulfilment for the delivery and the payment is Merano, Italy. The court of jurisdiction is Bolzano, Italy. The above mentioned conditions are to be considered as legally binding and recognized by the buyer, as long as no other regulations were agreed on and confirmed in written by Mussner. The legal relationship between the parties is governed by the Law of the Italian Republic.

12. privacy
Without your prior approval no personal data will be stored except data necessary to process the order and to administer the business relationship. The transfer of your personal information to the freight carrier will be limited to what is necessary to ship the order. No personal information will be released to others . Here for are applied the privacy rules of the Italian law (decreto n. 196/03).

13. concluding provisions
Should one or more regulations of these business terms and conditions or any other agreements be ineffective or become ineffective, it will not affect the other regulations or agreements.
